1. Acceptance of Terms
By accessing or using the Living Space Design website, services, or any related platforms , you agree to be bound by these Terms of Service . If you do not agree to all of these Terms, you may not use our Services. These Terms constitute a legally binding agreement between you and Living Space Design Inc..
2. Description of Services
Living Space Design provides premium home renovation, interior design, exterior styling, smart home installation, security system setup, fire safety consulting, solar panel installation, lawn installation, gutter installation, flooring, door installation, home décor curation, and home warranty plans. The specific scope, timeline, and cost of each project will be outlined in a separate Project Agreement between you and Living Space Design.
3. Project Agreements & Proposals
Before any work commences, Living Space Design will provide a written proposal or Project Agreement detailing the scope of work, estimated timeline, materials to be used, total cost, payment schedule, and warranty terms. The proposal is valid for 30 days from the date of issue unless otherwise stated. A signed Project Agreement and a non-refundable deposit (typically 25–35% of the total project cost) are required to confirm your booking and initiate work.
4. Pricing & Payments
All prices are quoted in USD unless otherwise specified. Prices are inclusive of labor and standard materials as described in the Project Agreement. Any changes to the scope of work (change orders) will be documented in writing and require your approval before additional costs are incurred. Payment is due according to the schedule outlined in your Project Agreement. Late payments may incur a fee of 1.5% per month on the outstanding balance. Living Space Design reserves the right to pause work if payments are more than 15 days overdue.
5. Change Orders
Any modifications to the original scope of work must be requested in writing and approved by both parties before execution. Change orders will include a description of the modification, cost impact, and any timeline adjustments. Unauthorized changes requested directly to on-site staff will not be honored.
6. Cancellation & Refund Policy
You may cancel a Project Agreement within 72 hours of signing for a full refund of any deposits paid. After 72 hours, the initial deposit becomes non-refundable as it covers procurement and scheduling costs. If Living Space Design cancels a project for reasons within our control, you will receive a full refund of all amounts paid within 30 business days. Cancellations due to force majeure events (natural disasters, pandemics, government mandates) will be handled on a case-by-case basis with a pro-rata refund for uncompleted work.
7. Warranties
Living Space Design provides a 10-year warranty on all structural work, finish quality, and installation defects performed by our team. This warranty does not cover normal wear and tear, damage caused by third parties, improper maintenance, or manufacturer defects in appliances and fixtures (which are covered by their respective manufacturer warranties). Warranty claims must be submitted in writing with supporting documentation and photos. Living Space Design will assess the claim and, if valid, repair or replace the defective work at no additional cost.
8. Client Responsibilities
You agree to provide timely access to your property as needed for project execution. You are responsible for removing personal belongings from work areas, securing pets, and ensuring the work environment is safe and accessible. You must obtain any required permits, HOA approvals, or regulatory clearances unless explicitly included in your Project Agreement. You agree not to interfere with or direct Living Space Design's subcontractors or employees during work hours.
9. Intellectual Property
All designs, plans, renderings, photographs, and other creative materials produced by Living Space Design remain our intellectual property unless explicitly assigned to you in writing. You may not reproduce, distribute, or use these materials for commercial purposes without our prior written consent. Living Space Design reserves the right to use photographs of completed projects for portfolio, marketing, and social media purposes unless you opt out in writing at the time of signing the Project Agreement.
10. Limitation of Liability
To the maximum extent permitted by law, Living Space Design's total liability for any claim arising out of or related to our Services shall not exceed the total amount you paid for the specific project in question. Living Space Design shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of income, or emotional distress.
11. Indemnification
You agree to indemnify, defend, and hold harmless Living Space Design, its officers, directors, employees, agents, and subcontractors from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your breach of these Terms, your negligence, or any misuse of the completed project.
12. Insurance
Living Space Design maintains comprehensive general liability insurance, workers' compensation coverage, and professional liability insurance. Certificates of insurance are available upon request. You are encouraged to maintain your own homeowner's insurance policy throughout the duration of the project.
13. Dispute Resolution
Any disputes arising out of or related to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association. Each party shall bear its own attorney's fees and arbitration costs unless the arbitrator determines otherwise.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
15. Modifications to Terms
Living Space Design reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any such changes constitutes your acceptance of the revised Terms. We will notify existing clients of material changes via email.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
